Online Course & Membership Site User Agreement – Terms & Conditions
These Terms and Conditions ("Agreement") govern your use of [The Artist Guild] (the "Program"), which is operated by [Rebecca King Art LLC] ("Company," "we," "us," or "our"). By accessing or using the Program, you agree to abide by these terms and conditions.
Effective Date: This agreement shall become effective upon the delivery and acceptance by the member upon granted access being given by the Company.
1. Membership Eligibility
1.1 You must be at least 18 years old to participate in the Program.
1.2 Your membership is personal to you and non-transferable.
- Program Description
2.1 The Program provides educational resources and training to artists on selling their art and building a business.
2.2 The Company reserves the right to modify or discontinue any aspect of the Program at any time.
- Payment and Billing
3.1 Membership fees, if applicable, are outlined on the Program's registration page.
3.2 Payments are processed through Kajabi or other authorized payment processors.
3.3 You agree to pay all fees associated with your membership promptly.
- No Guarantee of Income
4.1 You understand and acknowledge that the results and income levels achieved through the Program may vary.
4.2 The Company does not guarantee any specific financial results, and any success or income mentioned in testimonials or examples is not a guarantee of your potential success.
- Refund Policy
5.1 All sales final. Please refer to cancellation policy to cancel membership.
- Intellectual Property
6.1 All content provided through the Program, including but not limited to videos, materials, and resources, is owned by the Company or its licensors and is protected by intellectual property laws.
6.2 You may not reproduce, distribute, or use any Program content without explicit permission.
- Termination
7.1 The Company reserves the right to terminate your membership and access to the Program if you violate these terms and conditions or engage in any inappropriate conduct, including but not limited to violation of intellectual property rights, harassment of other members, or fraudulent activities.
- Privacy

- Disclaimers
9.1 The Company makes no warranties or representations about the accuracy or completeness of the Program's content.
9.2 The Program is provided on an "as-is" and "as available" basis.
9.3 The Company endeavors to provide accurate and up-to-date information within the Program; however, we make no warranties or representations regarding the accuracy, completeness, or reliability of any content provided. Users acknowledge that reliance on any information within the Program is at their own risk
- Limitation of Liability
10.1 To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages.
- Governing Law and Jurisdiction
11.1 This Agreement is governed by the laws of Bexar County, Texas, USA.
11.2 Any legal action arising out of or related to this Agreement shall be filed in the appropriate court located in Bexar County, Texas, USA.
- Entire Agreement
12.1 This Agreement constitutes the entire agreement between you and the Company regarding the Program and supersedes any prior agreements or understandings.
- Cancellation Policy
13.1 You may cancel your membership through the Kajabi dashboard. Your subscription shall continue until the end of the current month. The Participant shall not be charged by the Provider for any membership fees after the current membership period. Unless the Participant has canceled the Program prior to the monthly fee renewal date, the Participant remains responsible to pay all amounts owing under the payment plan for the Program.
13.2 It is the sole responsibility of the member to cancel if, for any reason, you want to discontinue the membership and stop payment.
13.3 Below are the directions for canceling the Program:
- Log in to your account on your desktop.
- Click on your Avatar (picture of you/gray profile in the top right corner)
- Select Settings from the dropdown.
- Click Billing Info in the top right of the page:
- Select the Cancel button
- After you click Cancel, you will be prompted to confirm your cancellation.
- Once confirmed, you will lose access to Subscription at the end of the current billing cycle.
- User Conduct and Community Guideline Clause
14.1 Users are expected to conduct themselves respectfully and professionally within the Program's community forums, discussion groups, and any other interactive features. The Company reserves the right to remove or restrict access to any content or user account that violates these guidelines.
- User Responsibility Clause
15.1 Users are responsible for maintaining the confidentiality of their login credentials and must not share account access with unauthorized individuals. Users are also responsible for any activities conducted under their account.
- Modification of Agreement Clause
16.1 The Company reserves the right to update or revise these terms and conditions at any time. Notice of any changes will be provided to users via email or by posting the updated terms on the Program's website. Continued use of the Program after such changes constitutes acceptance of the modified terms.
- Force Majeure Clause
17.1 The Company shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, or government actions.
18.1 USER RESPONSIBILITIES FOR ACCESS AND MEMBERSHIP
18.1 Login Credentials and Access
All users are solely responsible for maintaining the confidentiality of their login credentials, including usernames and passwords, and for ensuring the security of their accounts. Users must not share their login information with any third parties.
18.2 Completion of Content and Accessing Membership
Users are responsible for accessing and completing all content included in their membership. Failure to access or complete content does not entitle users to extended access beyond the agreed-upon subscription period.
18.3 Timely Access
The Company shall not be liable for any loss of access to membership content or services due to users' failure to log in, maintain their login credentials, or access the membership platform. Users acknowledge and accept that access to membership content may be restricted or revoked if login credentials are not used for an extended period.
18.4 Termination of Access
The Company reserves the right to terminate or suspend access to membership content or services if users fail to comply with these Terms of Service or if there is reasonable suspicion of unauthorized access or use of the account.
18.5 No Refunds or Extensions
Users understand and agree that failure to access or complete content within the subscription period does not entitle them to a refund or extension of their membership. All subscription fees are non-refundable, and access to membership content will be revoked upon expiration of the subscription period.
18.6 User Obligations
By accessing the membership platform, users acknowledge and agree to abide by all terms and conditions outlined in these Terms of Service, including their responsibilities for maintaining login credentials, accessing content in a timely manner, and complying with all usage guidelines.
18.7 Indemnification
Users agree to indemnify and hold The Company harmless from any claims, losses, or damages arising out of their failure to comply with the obligations outlined in this section, including any unauthorized access to membership content or services.
18.8 Modification of Terms
The Company reserves the right to modify or amend this section at any time without prior notice. Users are encouraged to review these terms periodically for updates or changes.
